Terms of Service

Preface

To provide high-quality, stable services to customers and establish a basis for dispute resolution, these Terms of Service are formulated.

When purchasing services or products, you must agree to these Terms of Service. If you have already purchased services or products and completed payment, you are considered to have agreed to these Terms of Service.

Users have the rights specified in these Terms of Service and must fulfill the obligations outlined in these terms. Disputes between users and 3xNets in the use of product services will be handled according to these terms.

3xNets reserves the final right to interpret this User Service Agreement.

Usage Terms

Servers sold by 3xNets do not include data security guarantees. Even servers using Raid10+BBU architecture do not include data security guarantees. 3xNets cannot compensate you for the value of your data.
The use of tools that harm the security of the networks of the three major Chinese telecom operators is prohibited.
To ensure stable network packet transmission, tools such as FinalSpeed that send multiple packets are prohibited, and continuous occupation of a large amount of bandwidth is prohibited.
It is prohibited to store, provide, or publish content that violates the laws of the server location, Japan, or China.
Reselling 3xNets services or products without authorization is prohibited.
Running software that consumes significant CPU, bandwidth, or disk resources is prohibited, including traffic mining, CDN, public network proxy, virtual currency mining, video hanging, cluster computing, PT service, traffic exchange, scraping, and similar activities.
Using BT software, such as BT, Thunder, and uTorrent, is prohibited.
It is prohibited to send packets externally or internally, perform DDoS attacks, ARP attacks, ARP hijacking, scan weak passwords, maliciously enumerate, send spam or junk mail, or interfere with the operation of other servers.
When using our services, you must comply with Australian laws and the laws of the server location.
3xNets only guarantees the normal operation of the products and services sold and provided. 3xNets has no obligation to assist with software issues.
You must use the support ticket system reasonably, respect customer service, and refrain from abusing customer service, sending meaningless tickets, harassment, or continuous entanglement.
Nesting of virtualization is prohibited for all server series except dedicated servers.
Do not place promotional links on websites not owned by you. Once discovered, promotional fees may be refused and the promotional link account may be closed.
Once the above prohibited behaviors are discovered, services may be immediately withdrawn and no refund will be made.

Cloud Server IPv4 Address Replacement

Cloud server IPv4 addresses can be purchased as additional products and will be automatically replaced after purchase. This feature is currently not yet implemented. Please submit a support ticket temporarily.
Cloud server IPv4 addresses can be changed for a fee of USD $5.00 per change. Each VPS is allowed to change its IP no more than twice per month.
If you require a specific IP address range, please contact our sales team for a solution.
If the IPv4 address is still blocked after replacement, you can submit a support ticket for free manual replacement within 24 hours. If more than 24 hours have passed, the IP replacement is considered complete.
If a large number of IP addresses are blocked during special periods, 3xNets reserves the right to temporarily increase prices.
If the IPv4 address is blocked in certain countries during the device rental period due to the user's own usage, 3xNets may charge an IPv4 address property loss fee depending on the situation.

Fault Compensation

Failures caused by data center routing equipment or power equipment are not compensated.
Failures caused by natural disasters and factors beyond our control are not compensated.
Failures caused by 3xNets are compensated according to a 1:2 compensation standard. If the failure is less than 24 hours, it is calculated as 24 hours.
Compensation is issued within 3-5 days after the fault is restored. The product must be in valid operation to be eligible for compensation.

Cloud Server Transfer Instructions

The initial activation security period for transfers is 3 days and cannot be manually initiated earlier.
Transfer fee per occurrence: USD $2.50. The minimum charge for each transfer is USD $2.50.
The available duration of transferable products must be greater than 15 days for monthly products, and greater than 60 days for annual, biennial, or triennial products.

Refund Guarantee and Payment Dispute

For transactions within 3 days and under 10GB of data usage, with an individual amount of RMB 50 or less, a full refund can be made to the account balance, which is non-withdrawable.
For transactions within 3 days and under 10GB of data usage, with an individual amount over RMB 50, a full refund can be made to the account balance, or refunded via the original payment method or to a customer-specified account after deducting a fee of RMB 5 plus 5% of the total amount.
No-refund products are not refundable unless due to unrepairable routing changes or machine failures that result in unavailability or decreased usability. In such cases, a refund may be made based on the remaining value of the product.

Refunds are not available in the following circumstances:

The assigned IP is blocked by the GFW or by national or regional authorities.
The product was purchased through promotional activities or with discount codes.
Presale products are in the Running or Active state.
Three or more refund requests in one day are considered malicious consumption, and 3xNets has the right to suspend the account.
For one account, more than five service cancellations through refunds are considered malicious consumption, and 3xNets has the right to suspend the account.
Registering more than one account and requesting refunds more than three times may result in account suspension.

3xNets is not responsible for service inaccessibility or data loss due to the user's improper actions or related behaviors.
3xNets is not responsible for service inaccessibility or data loss caused by the user's website content or actions that violate the Terms of Service or Usage Terms.
3xNets is not responsible for service inaccessibility or data loss caused by uncontrollable social or natural factors.
3xNets is not responsible for service inaccessibility or data loss caused by the user's self-ISO installation of the operating system or DD operation.

Reserved Rights

3xNets reserves the final right to interpret these terms.
3xNets reserves the right to modify these terms without further notice.
